The attorneys representing the CL Financial shareholders in the winding up petition in the high court were denied a request to have the matter adjourned.
The attorneys say they were only retained by the shareholders late last year and it did not allow them enough time to review the documents.
The judge did not buy their excuse and it wasn't their only loss for the day.
And Scotiabank is recording a 9 percent increase in its income after-tax for a nine month period.
